Managing Regulatory Risk through Strict Adherence

Australian Collection Services (ACS) ensures absolute compliance with the National Credit Code (NCC), National Consumer Credit Protection Act (NCCP) and ACCC/ASIC Debt Collection Guideline (Guidelines) through thorough and regular training of staff/agents, combined with internal management systems to accurately identify, measure and facilitate compliance with all relevant laws, regulations and prescribed procedures.
ACS have employed the services of a Legal and Compliance consulting firm to further enhance compliance understanding and interpretation. Over the years the above codes and guidelines have gone through significant change and focus, forcing the industry to pay close attention and change practises accordingly. 
Teaming together, with both Clients and Compliance consultants, ARS have been able to clearly document its Operational Framework, including work instructions to complement Training of Sub-Agents and the day to day running of the Business.

ACS can provide peace of mind for their Clients when dealing with the complexities of Trespass laws of Consumer and Commercial loans alike, Customer contact guidelines and Privacy of Customer and Client information.

Comprehensive Training through BeeBox

Our training is managed through BeeBox, an online regulatory compliance service. Staff, management, and contractors are required to undertake the course which is relevant to their roles and the knowledge they need to perform them. The course covers two main categories associated with our industry – debt collection regulatory environment and Privacy, including:
  • Part 1 - ACCC & ASIC Debt Collection Guidelines 2021,
  • Part 2 - Consumer Vulnerability. Business Guide to the Australian Consumer Law 2021,
  • Part 3 - National Consumer Credit Code 2009,
  • Part 4 - ASIC Regulatory Guide 271 Dispute Resolution & Hardship
  • Part 5 - The Privacy Act 1988 & Australian Privacy Principles,
  • Part 6 - Anti-Money Laundering & Counter-Terrorism Financing Rules 2007,
  • Part 7 - Modern Slavery Act 2018,
  • Part 8 - Mercantile Agent Practices & Corporate Governance & Ethics,
  • Part 9 - Banking Code of Practice 2021 (supplementary training manual). 
We monitor our regulatory environment for changes that require updated training, which is managed through on the job training delivered through personal discussions, staff meetings, contractor bulletins and client instruction changes.

Our training register, and the CreditWise system, details the training requirements for each staff member and contractor and completion records.

Our Data Security

Our online IT systems are hosted by VentraIP at NEXTDC data centre in Sydney, Australia. NEXTDC data centre infrastructure is designed to a minimum of UTI Tier III standard, which means N+1 redundancy on all critical systems. This translates to extremely high levels of service availability.

The physical security includes a multi-layered access system. There’s individual authentication using combined biometric fingerprint technology and ID access cards (IDACs), as well as an extensive CCTV network and 24/7 onsite security staff.

In addition to physical security of the data centre, our server is also protected Corero DDoS mitigation devices, ModSecurity Web Application Firewall (WAF) and an additional proprietory WAF at application level.

All data transmission to/from Australian Collection Services web server is via encrypted https connection. Sectigo protects our system from intrusion and cyber attack.  Sectigo is a leading provider of digital identity solutions, including SSL / TLS certificates, DevOps, IoT, and enterprise-grade PKI (Public Key Infrastructure) management, as well as multi-layered web security. It is also the world's largest.  Our SSL Certificate is able to be tested HERE (A+ result)

Australian Collection Services utilises our own dedicated Fully Managed VPS hosting account - located right here in Australia, with 24/7 year-round Australian based monitoring and support. Our VPS  hosting security includes; Config Server Firewall, CageFS, ModSecurity, 'Fortinet' Hardware firewall, 'Halon' outbound email filtering and 'Monarx' malware/virus scanner.
